Fee’s : Fee Agreements and Commonly Used Industry Standard Methods

Consultant’s fees are often complex due a number of variable factors associated with
any Construction Project including for example the length of commission, the variety
of different roles or stages of work an Architect can be appointed to undertake, and
the potential for projects to vary in size and complexity at different stages.
From inception of a building project to its completion is more frequently a matter of
years or months rather than weeks or days. Within this timescale, an Architect can be
commissioned to undertake a variety of different task at different stages of a project
as outlined in Royal Institute of British Architects (RIBA) Plan of Works which
defines the Architect’s role into a series of stages (A to L). When appointing an
Architect the Client is able to stipulate which stages of the plan are being
commissioned to meet their requirements.

Architects are most commonly appointed with a fee defined as a percentage of
construction cost to undertake defined stages of work in reference to the RIBA Plan
of Works. The percentage basis of the fee provides flexibility within a fee agreement
for it to vary according to the size and complexity of the project. (As the project value
varies the Architect’s fee alters accordingly.) Based on this approach RIBA used to
publish an industry standard percentage based fee scale to assist both Clients and
Architects but we understand this had to be withdrawn due to changes in competition
law and under the directive of the OFT.

Alternative fee arrangement methods are available by determining a fixed fee or by
appointment on a time charged basis.
